Dale and Mike Parak were twin brothers and best friends. They spent their entire lives looking out for each other’s interests. When growing up, the two were inseparable. They played sports together, double-dated frequently, and attended the same university. They grew closer as they aged, they got married about the same time, and eventually both were divorced. After they retired from their jobs, they decided to live together to save money and because they still enjoyed each other’s company.

When he was 70 years old, Mike was diagnosed with cancer. Doctors predicted that he had about six months to live. The brothers, however, agreed that Mike should not suffer. Mike and Dale wrote and signed a note stating that they decided to commit suicide. Dale broke 20 tranquilizers into Mike’s evening meal and watched as he ate it. Yet when Dale checked on Mike one hour later, Mike was still alive. Dale panicked. He took a .38-caliber revolver from his desk and shot Mike, killing him instantly. Dale then went into the kitchen and took a handful of tranquilizers. He did not die. He awoke the next morning as somebody pounded on the front door. It was a neighbor who, seeing that Dale was dazed and confused, decided to call an ambulance and the police.

The responding police officer conducted an investigation, and Dale was arrested and charged with the murder of his brother, Mike. The prosecutor, although noting it to be a difficult case, pursued the case because she thought no citizen had the right to decide when someone should die. Dale Parak pled guilty to first-degree manslaughter and was sentenced to five years in a maximum-security prison. (Note that this was the lowest sentence that could be given to a defendant convicted of his crime).

You must take on the perspective of your major field of study and explain in your paper what that perspective is and how it informs your view of the topic. The topics listed above are far too broad to write about in 10–12 pages (3,300–3,900 words). Instead, you must choose a narrowly defined thesis and approach it from the perspective of your field.

Example: If you are an economics major, and you are interested in immigration reform, you should approach a very specific aspect of immigration reform through the lens of economic theory and practice. A specific thesis question would not be, “How does illegal immigration influence the U.S. economy?” One could write thousands of pages on such a topic. Instead, a better question would be, “How do illegal immigrant hotel workers in Chicago impact the economy of Northern Illinois?” You would then want to do the research and determine the positive and negative impacts they have, ultimately trying to conclude how illegal immigration in this area should be approached ethically.

How to Hone Your Thesis: It is important that you start your research early in this course. Try to find the most important contemporary questions and theories in your field of study and then align the most important questions with a very specific aspect of the general topics above. When a patient is informed and educated on the risks versus benefits, he/she can make choices without the inference of the healthcare proxy. End-of-life issues are even more difficult. Unfortunately, by adhering to the current standards, patients have suffered from not being able to make decisions that are followed through by health care professionals. This is because of numerous reasons. The purpose of this paper will show research and discuss current options to preserve patient autonomy, examine policies/procedures that surround end-of-life, case law and current legislation. My thesis will conclude by proposing changes in policies to better protect patients and preserving patient autonomy.
Definition of patient autonomy
What is autonomy?
“The right of patients to make decisions about their medical care without their health care provider trying to influence the decision. Patient autonomy does allow for health care providers to educate the patient but does not allow the health care provider to make the decision for the patient.”
Define Problem
End-of-life is a difficult time for all and should not be complicated by having family members, physicians or judicial system trying to predict what treatments patients would have wanted. A competent patient should be able to make medical decisions without any meddling from healthcare professionals.
Identify goal
The primary goal of protecting patient autonomy is to preserve the human dignity and autonomy of the person. The ultimate hope would be for all members of society to make their wishes known to healthcare professionals and the healthcare proxy would abide by them.
Background/History
Patient Self-Determination Act (PSDA): The Federal Patient Self-Determination Act confirms the fact that autonomy is one of the core ethics in American healthcare, if not the dominant ethic. Consistent with this, when patients are able to speak for themselves, informed consent is a fundamental prerequisite to providing care. When patients are unable to speak for themselves, the American medical and legal system still strives to ensure that patients’ autonomy is respected with the use of advance directives. Provide written information to all adult patients on their rights under state law to make decisions—including information about the right to execute an advance directive and how the institution implements them.
Document presence of an advance directive in a patient’s medical record.
Provide education for staff and the community about advance directives.
Incomplete Advance Directives: The Agency for Healthcare Research and Quality (AHRQ) studies found only 18-36 percent of the adult population have completed advance directives and less than 50 percent of the severely or terminally ill patients studied had an advance directive.
