The OSHA regulation at 29 C.F.R. §1910.1000(d) requires employers to determine the cumulative exposure of workers to certain gases over an 8-hr work shift using the following formula:
E = CaTa + CbTb + …. + CnTn
8
E is the equivalent exposure for the work shift,
C is the concentration during any period of time in which the concentration remains constant, and
T is the duration of time in hours of the exposure.

The regulation further stipulates that no employee can be further exposed to the gas when the value of E exceeds the 8-hr time-weighted average limit set for the given substance. If a worker is exposed to ammonia concentrations throughout the workday as follows, 125 ppm for 4 hr; 75 ppm for 2 hr; and 25 ppm for 2 hr, determine the equivalent exposure (E):

Assignment 4: Legal and Ethical Considerations in Marketing, Product Safety, and Intellectual Property

Due Week 9 and worth 300 points

You are a new associate at the law firm of Dewey, Chetum, and Howe. John, a former researcher at PharmaCARE, comes to your office. He has concerns about PharmaCARE’s use of AD23, one of the company’s top-selling diabetes drugs. Two (2) years ago, after PharmaCARE’s research indicated that AD23 might also slow the progression of Alzheimer’s disease, John and his team of pharmacists began reformulating the drug to maximize that effect. In order to avoid the Food and Drug Administration’s (FDA) scrutiny, PharmaCARE established a wholly-owned subsidiary, CompCARE, to operate as a compounding pharmacy to sell the new formulation to individuals on a prescription basis. CompCARE established itself in a suburban office park near its parent’s headquarters. To conserve money and time, CompCARE did a quick, low-cost renovation.

CompCARE benefited from PharmaCARE’s reputation, databases, networks, and sales and marketing expertise, and within six (6) months had the medical community buzzing about AD23. Demand soared, particularly among Medicare, Medicaid, and Veterans Affairs patients. Seeing the opportunity to realize even more profit, CompCARE began advertising AD23 directly to consumers and marketing the drug directly to hospitals, clinics, and physician offices, even though compounding pharmacies are not permitted to sell drugs in bulk for general use. To circumvent this technicality, CompCARE encouraged doctors to fax lists of fictitious patient names to CompCARE. PharmaCARE sold CompCARE to WellCo, a large drugstore chain, just weeks before AD23 was publicly linked to over 200 cardiac deaths.

As CompCARE and its new parent company enjoyed record profits and PharmaCARE’s stock price approached $300 per share, reports started surfacing that people who received AD23 seemed to be suffering heart attacks at an alarming rate. The company ignored this data and continued filling large orders and paying huge bonuses to all the executives and managers, including John, whose wife recently died from a heart attack after using AD23.

Discuss how the Gladstone Committee Report addressed conflict over the words rehabilitation and treatment.

In 1895, a report called Report from the Departmental Committee on Prisons, also known as the Gladstone Committee Report (GCR), was developed. The purpose of this report was to introduce ideas regarding rehabilitation in the United Kingdom.

An example of the impact in the United States was the creation of the standardized sentencing guidelines and the continual amendments used to assist offenders. In the United Kingdom, the GCR influenced how rehabilitation programs were being developed.

Discuss how the Gladstone Committee Report addressed conflict over the words rehabilitation and treatment. In this discussion, identify which word you would choose and the impact it has on society.

Your Writing Prompt

Based on your research, identify and analyze a human rights issue in your novel and show how it relates to real-life issues and affects people within the United States and one other country.

Introduction
From “fact sheets” by the University of Washington, did you know there is a connection between mental illness and violence being promoted by social media? The mentally incapacitated society has been demoralized for a plethora of years. Social media has had a caustic relationship with the mentally ill for a myriad of years. We need to help the mentally challenged society to improve their lives. We need to quit discriminating against the handicapped society. We have to stand together to prevent discrimination, provide health care, and provide job opportunities.
For example in my book “of mice and men” they had poor health care and could not find jobs because they were being discriminated against. Furthermore we need to provide more job programs to help the disabled community.
We have to stand together to prevent discrimination, provide health care, and provide job opportunities.
Second Paragraph (Your novel info. As you develop your second paragraph remember that this is the paragraph that will help explain how your novel demonstrates that real life issue. For example, if I was reading the Hunger Games I would focus here on how Katniss was affected because of governments and people turning a blind eye to poverty)
Job employers discriminate against mentally challenged people.

From “the jury awards 13 million in discrimination case.” –VR hub.com, this shows a pizza worker being fired because of a “mental retardation.” People still discriminate today against mentally challenged population. My reasoning is from the article that a mentally challenged employee was working at a pizza restaurant and got fired because of his disability. There are law set in place for the mentally challenged community to help prevent discrimination. We need to be more rigorous on the law to prevent job employers from discriminating due to ones mental state.

This supports my claim because it talks about discrimination to mentally challenged people.

The rights of people once they have been incarcerated can be a controversial topic of discussion. Discuss the healthcare rights of the incarcerated population.

Review the attached PowerPoints presentations. Once done answer the following questions:
1. Do you feel it is better to allow individuals the freedom to choose any type of (or no) health insurance coverage available to them or to increase government involvement in a person’s/family’s healthcare via mandates, such as the ACA and/or the government as a single insurer for all residents. Why?
2. Discuss the mission of the Patient-Centered Outcomes Research Institute (PCORI) and the Center for Medicare & Medicaid Innovation (CMMI).
3.If you could reform the malpractice or tort laws, what types of changes would you make? When do you feel it is appropriate for someone to claim damages from medical procedures or treatment? Do you feel there should be a cap on the payments, and if so, how would you decide what that cap would be? What are all the different costs involved in medical malpractice suites? Is it easier to talk about tort reform than to actually try to define it?
4. The rights of people once they have been incarcerated can be a controversial topic of discussion. Discuss the healthcare rights of the incarcerated population. What do you feel should or should not be provided to those who are imprisoned? Are there certain tests or procedures that they feel should be performed routinely? Why or why not? What is the nurse’s role, based on the section on page 248?
– APA format word document, Arial 12 font.
– A minimum of 3 evidence-based references no older than 5 years (excluding the class textbook) are required.
